On December 19, 2021, our office, on behalf of Israel’s Democracy Guard (an NGO working to protect democratic principles), appealed to the members of the city council of Beitar Illit (a small city close to Jerusalem) demanding they suspend its mayor from his position, due to significant suspicions about his involvement in a murder about 25 years ago.

 

In a letter to the members of the Council, we emphasized that there it is expected that an elected official would serve as an example and symbol of a moral role model.

 

We argued that when there are significant suspicions by the police for serious offenses such as murder, it disrupts any possibility of providing an example and role model to the general public, for fairness and honesty.

 

Existence of administrative evidence such as solid suspicions of committing the most serious offense in the law book may have great weight in relation to the continued exercise of his right to hold a public office as an elected official.

 

We mentioned that there is no contradiction between the presumption of innocence in criminal law and an administrative determination based on administrative evidence that a person was involved in crimes.

 

Administrative evidence does not amount to a conviction and does not turn a person who is believed to be innocent into one who has been convicted by law.
